Terms and Agreement
OVERVIEW: Client and Be Alined agree to begin a working relationship to meet a proposed goal. Be Alined agrees to provide services and assistance to the best of abilities to fulfill the proposed solutions within a reasonable amount of time as discussed; will strive to meet your expectations; and agrees to work with honesty, integrity, and a positive demeanor. Be Alined will keep Client’s information confidential and will work ethically and efficiently, and will use reasonable care in performance, but shall not accept responsibility for any damage to client's person or property that is not the direct result of gross negligence of Be Alined. Be Alined will not accept responsibility for damages that exceed the amount of service fees billed and will not be liable for any consequential or incidental damages.
PAYMENT, SCHEDULING AND CANCELLATION: Sessions are prescheduled with mutual agreement between Client(s) and Be Alined. Credit card/ payment information may be kept on file and encrypted. All packages require prepayment or credit or debit card on file for dates to be held. Hours are labor hours. If within one hour of starting work, Client is unsatisfied with onsite services and a reasonable resolution cannot be achieved, all funds will be returned to Client. No refunds will be provided for any service, completed research or design work, unused package sessions/ time after a 60 day delay between sessions, or as otherwise stated for a special offer or promotion. Gift certificates are nonrefundable yet are transferable and must be redeemed within one year of issue unless otherwise stated. There will be a charge of $50 for for insufficient funds or any bank draft items that are not payable for any reason, as well as additional collection and/or legal fees to compensate for related charges and unpaid balances. 50% of session cost will be charged if client cancels within 48 hours of prior set date scheduled. Delays due to weather or forces of nature beyond Be Alined’s control will require no-fee rescheduling to a mutually agreeable time. Be Alined reserves the right to withdraw from a project at any time if project involves perceived unsafe working conditions, Client is in breach of this agreement, or if Be Alined cannot render services requested by Client through no fault of Be Alined.
SUBSCRIPTION SERVICES (REGULAR REFRESH): Eligible to clients who have previously completed 6 or more organizing sessions. Availability is limited and subject to change. Be Alined will collect payment details and keep encrypted. Billing will take place monthly before the 5th day, and a receipt will be provided via email if requested. 12x per year or 6x per year commitment is required and may be canceled with 10 days notice. A standing date and time (i.e., the second Tuesday of each month) will be scheduled and time will be dedicated to Client. Session cancellation terms as above apply. If rescheduling from set date is required, there is no guarantee another date in the same month will be available though every effort will be made.
EXTERNAL SERVICES, CHARITIES AND RETAILERS: Be Alined may suggest charities, service providers and/or retailers, and may coordinate on Client’s behalf. Each external party’s individual policies for services, product purchases, returns, installation, delivery and any applicable taxes shall apply. Be Alined is not responsible or liable for any claims related to or arising from services or products provided by third party vendors. As part of services, Be Alined partners with retailers, vendors, and consultants as needed. Any estimate is intended to provide an “at a glance” view of anticipated project costs when external parties are engaged. Each retailer or vendor’s policies for product purchase, sale pricing periods (beginning date, end date, terms of service within), returns, installation, and delivery fees, unless otherwise noted, plus applicable taxes, will apply. Any payment collected on Client’s behalf is payable to that vendor or retailer directly; Be Alined serves only as a project manager facilitating the sale or purchase.
COMMUNICATION METHODS, INFORMATION SHARING AND PROTECTION: Client and Be Alined will communicate via phone, text message, email and phone generally. Client provides express permission to email and use the communication methods, and can provide preferred methods as well. Be Alined has permission to use testimonies and photos in marketing materials. Client will be identified anonymously or by first name only. Be Alined warrants that at no time will Client testimony, pictures or name be used to promote unlawful or morally objectionable activities including but not limited to activities designed to defame, embarrass, harm or abuse third parties; or hate crime of any kind. A Client’s personal information will never be sold or distributed.
INDEMNITY, ILLNESS OR INJURY: Be Alined endeavors to provide services with no illness or injury and works with precautions to avoid illness or injury to others. It is expected, given recent health concerns, that each party will take utmost precautions as suggested by the CDC (Centers For Disease Control and Prevention), to limit exposure to viruses, bacteria, and germs generally. Masks, disinfecting of surfaces, and limited personnel or Clients within a home may be required. It may be required for and it may be requested that: parties wear a protective face mask during all interaction, that only one person be in a room with Be Alined during session(s) or that sessions be cancelled, rescheduled, or postponed. It is mandatory, for the safety of all involved, that anyone in the household exhibiting symptoms of or who have been diagnosed with a communicable disease disclose details to Be Alined immediately. It is agreed and understood that Be Alined will not be held liable in any way for any client or members of their household who contract Covid-19 or any communicable disease. Client and Be Alined both understand the general risk of sharing space of other parties, and agree to disclose symptoms of sickness for parties to make an informed decision to cancel or reschedule planned work. If work will continue, neither party will hold the other accountable for communicable illness. It is noted there is a shared responsibility in limiting exposure to any illness.
AGREEMENT Moving forward with scheduling and/or payment with Organizer signifies complete agreement with these Terms. A copy of these Terms is included with invoices.
